Declaration of citizenship acquisition by benefit of Law

The declaration of acquisition is made by both parents, who must appear in person at the Consulate, without an appointment, exclusively on Tuesdays and Thursdays between 9:00am and 12:00pm.
Please take a ticket upon arrival and wait to be called. It is recommended to arrive at 9:00am, as only a limited number of clients can be assisted on those days.

The following documents must be provided:

  • The request for transcription of the minor’s birth, which will be prepared and subsequently signed at the Consulate.

  • The original birth certificate, issued by the Registry of Births, Deaths and Marriages, legalized by apostille (issued by the Department of Foreign Affairs and Trade).

  • The Italian translation of the birth certificate, carried out by a NAATI-certified translator or done independently. If translating independently, please note that the translation must fully match the original text. If this Office detects discrepancies with the English text or missing elements, all documentation will be returned for correction.
Please note that the apostille does NOT need to be translated, and the translation does NOT require legalization by apostille.

  • A copy of the birth certificate issued by the Italian municipality of the Italian parent through whom citizenship is claimed, even if that parent was born abroad. A copy is sufficient; the original is not required.

  • Readable colour photocopies of the biographical pages of the parents’ and minor’s valid passports; the Italian parent(s) must present a valid Italian passport or identity card.
