{"id":4475,"date":"2025-11-20T12:48:50","date_gmt":"2025-11-20T04:48:50","guid":{"rendered":"https:\/\/consperth.esteri.it\/?page_id=4475"},"modified":"2026-03-12T14:57:43","modified_gmt":"2026-03-12T06:57:43","slug":"declaration-of-citizenship-acquisition-by-benefit-of-law","status":"publish","type":"page","link":"https:\/\/consperth.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/stato-civile\/nascita\/declaration-of-citizenship-acquisition-by-benefit-of-law\/","title":{"rendered":"Declaration of citizenship acquisition by benefit of Law"},"content":{"rendered":"<p data-start=\"0\" data-end=\"189\">The declaration of acquisition is made <strong data-start=\"39\" data-end=\"69\">in person at the Consulate<\/strong>, after <strong data-start=\"77\" data-end=\"108\">sending in advance by email<\/strong> all the <strong data-start=\"117\" data-end=\"155\">scanned and complete documentation<\/strong> to <a href=\"mailto:perth.consolato@esteri.it\"><strong data-start=\"159\" data-end=\"188\">perth.consolato@esteri.it<\/strong><\/a>.<\/p>\n<p data-start=\"191\" data-end=\"384\">Once the documentation has been reviewed, the officer will <strong data-start=\"250\" data-end=\"303\">contact the applicants by email within a few days<\/strong>, scheduling them <strong data-start=\"321\" data-end=\"383\">on Tuesdays and Thursdays between 9:00 a.m. and 12:00 noon<\/strong>.<\/p>\n<p data-start=\"386\" data-end=\"564\" data-is-last-node=\"\" data-is-only-node=\"\">Therefore, <strong data-start=\"397\" data-end=\"427\">no appointment is required<\/strong>. Applicants only need to <strong data-start=\"453\" data-end=\"470\">send an email<\/strong>\u2014attaching copies of the documentation and the relevant form\u2014to <strong data-start=\"534\" data-end=\"563\"><a class=\"decorated-link cursor-pointer\" rel=\"noopener\" data-start=\"536\" data-end=\"561\">perth.consolato@esteri.it<\/a><\/strong>.<\/p>\n<p data-start=\"390\" data-end=\"431\">The following documents must be provided:<\/p>\n<ul data-start=\"433\" data-end=\"1739\">\n<li data-start=\"433\" data-end=\"555\">\n<p data-start=\"435\" data-end=\"555\">the <a href=\"https:\/\/consperth.esteri.it\/wp-content\/uploads\/2026\/01\/20260119124008996-1.pdf\"><strong data-start=\"439\" data-end=\"489\">request for transcription of the minor\u2019s birth<\/strong><\/a>, which will be prepared and subsequently signed at the Consulate;<\/p>\n<\/li>\n<li data-start=\"556\" data-end=\"749\">\n<p data-start=\"558\" data-end=\"749\">the <strong data-start=\"562\" data-end=\"592\">original birth certificate<\/strong>, issued by the <em data-start=\"608\" data-end=\"650\">Registry of Births, Deaths and Marriages<\/em>, legalized by means of an <strong data-start=\"677\" data-end=\"690\">apostille<\/strong> (issued by the <em data-start=\"706\" data-end=\"747\">Department of Foreign Affairs and Trade<\/em>);<\/p>\n<\/li>\n<li data-start=\"750\" data-end=\"1291\">\n<p data-start=\"752\" data-end=\"1291\">the <strong data-start=\"756\" data-end=\"804\">Italian translation of the birth certificate<\/strong>, carried out either by a <strong data-start=\"830\" data-end=\"869\">NAATI-certified official translator<\/strong> or independently.<br data-start=\"887\" data-end=\"890\" \/>If an independent translation is submitted, it must be <strong data-start=\"947\" data-end=\"990\">fully consistent with the original text<\/strong>. Should this Office find any discrepancies with the English text or any missing elements, the entire documentation will be returned to the applicant for completion.<br data-start=\"1155\" data-end=\"1158\" \/>Please note that <strong data-start=\"1177\" data-end=\"1224\">no translation of the apostille is required<\/strong>, and <strong data-start=\"1230\" data-end=\"1290\">no apostille legalization of the translation is required<\/strong>;<\/p>\n<\/li>\n<li data-start=\"1292\" data-end=\"1532\">\n<p data-start=\"1294\" data-end=\"1532\">a <strong data-start=\"1296\" data-end=\"1329\">copy of the citizenship certificate by birth <\/strong>issued by the Italian municipality of the Italian parent through whom citizenship is claimed, even if that parent was born abroad; <strong><span style=\"text-decoration: underline;\">Only for AIRE-registered citizens born in Western Australia<\/span>, a <a href=\"https:\/\/consperth.esteri.it\/wp-content\/uploads\/2026\/03\/1-DICHIARAZIONE-SOSTITUTIVA-DI-CERTIFICAZIONE.pdf\" rel=\"attachment wp-att-4745\">AUTOCERTIFICAZIONE DI CITTADINANZA ITALIANA PER NASCITA<\/a> can replace the parent\u2019s citizenship certificate.<\/strong><\/p>\n<\/li>\n<li data-start=\"1533\" data-end=\"1739\">\n<p data-start=\"1535\" data-end=\"1739\"><strong data-start=\"1535\" data-end=\"1571\">clear, legible color photocopies<\/strong> of the biographical pages of the <strong data-start=\"1605\" data-end=\"1624\">valid passports<\/strong> of the parents and of the minor; the Italian parent(s) must present a <strong data-start=\"1695\" data-end=\"1738\">valid Italian passport or identity card<\/strong>.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1741\" data-end=\"2037\">As of <strong data-start=\"1747\" data-end=\"1765\">1 January 2026<\/strong>, for applications for the acquisition of citizenship <strong data-start=\"1819\" data-end=\"1842\">\u201cby benefit of law\u201d<\/strong> for <strong data-start=\"1847\" data-end=\"1882\">children, <\/strong><span style=\"color: #0000ff;\"><strong data-start=\"1884\" data-end=\"1926\">no administrative fee will be required<\/strong><\/span>, as Law no. 30 of 30 December 2025 introduced <strong data-start=\"1973\" data-end=\"2001\">free of charge provision<\/strong> for this specific consular service.<\/p>\n<p data-start=\"2039\" data-end=\"2246\">It is further noted that <strong data-start=\"2064\" data-end=\"2111\">declarations to be submitted by 31 May 2029<\/strong>\u00a0concerning <strong data-start=\"2123\" data-end=\"2213\">children of at least one Italian citizen by birth who were still minors on 24 May 2025<\/strong> will also be <strong data-start=\"2227\" data-end=\"2245\">free of charge<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"The declaration of acquisition is made in person at the Consulate, after sending in advance by email all the scanned and complete documentation to perth.consolato@esteri.it.
